Supervisory detention is an investigative method that has been established since 2018 in China and has taken the place of the previous internal disciplinary process of CCP: shuanggui.The purpose of setting up supervisory detention is to combat the corruption of Communist Party members or public sector personnel. During supervisory detention, a detainee’s” freedom is restricted due to being incommunicado, and the right to counsel is violated. Additionally, the broad criticism is that evidentiary materials collected during supervisory detention, especially confessions, will be used in subsequent criminal proceedings if the detainee has been found to have committed a crime. This presentation reiterates the nature of supervisory detention and discusses the flaws of supervisory detention, advocating viable remedial suggestions from the perspective of the detainees’ rights protection.
